Facts of the case.
The applicant was appointed as Junior assistant in the year 1972. thereafter he promoted as Senior Assistant. While so, a punishment was imposed for the reason that he misrepresented to his higher Officer. The punishment was that postponement of one increment without cumulative effect and the said punishment was completed on 13-2-2008, during the course of punishment his junior were got promotion as office superintendent. While matter stood thus, the applicant submitted a representation that to give him promotion as office superintendent in the office of the respondents-authorities. No orders were passed on the representations of the applicant apart from that the respondent again gave promotion to his juniors. Under these circumstance the applicant approached to the Hon’ble Tribunal to set-aside the promotions on the ground that the promotes were juniors to him. The Hon’ble Administrative Tribunal after conducting through enquiry and granted interim relief, directing the respondent -Government to pass orders on the representations of the applicant. Ignoring the same the respondents against given promotions to his juniors and the same was questioned by filing fresh Miscellaneous application in Main and HERD ORIGINAL APPLICATION IS ALLOWED
